WAIVER OF LIABILITY AND MEDICAL DISCLAIMER
Mywowfit (Online Fitness Technologies, Inc. & MYWOWFIT OÜ)

This Waiver of Liability and Medical Disclaimer ("Agreement") is made by and between Online Fitness Technologies, Inc., a U.S.-based company ("Mywowfit US"), MYWOWFIT OÜ, an Estonian company ("Mywowfit EU"), collectively referred to as "Mywowfit," "we," "us," or "our," and the undersigned individual ("Client," "you," or "your"). By engaging in 1-on-1 virtual personal training, fitness, or yoga sessions through Mywowfit’s platform, you acknowledge and agree to the following terms:
1. DISCLAIMER OF MEDICAL ADVICE
- Mywowfit does not provide medical advice, diagnosis, or treatment.
- All information provided by Mywowfit, including text, images, graphics, audio, video, and live sessions, is for informational purposes only.
- Clients should consult their healthcare provider before beginning any fitness program.
- Personal trainers are certified fitness professionals but are not medical doctors or licensed healthcare providers.
2. ASSUMPTION OF RISK
- Clients acknowledge that engaging in physical exercise involves risks, including muscle strain, cardiovascular issues, and injuries.
- Clients assume full responsibility for their participation in Mywowfit training sessions.
- Failure to follow trainer instructions may result in injury, for which Mywowfit is not responsible.
3. WAIVER OF LIABILITY
- Clients release and discharge Mywowfit US, Mywowfit EU, and their affiliates from all claims related to training sessions.
- Clients agree to indemnify Mywowfit for any claims arising from undisclosed medical conditions or failure to seek medical attention.
4. EMERGENCY PROTOCOLS & CLIENT RESPONSIBILITY
- Mywowfit does not provide emergency medical assistance.
- Clients must stop immediately and seek medical help in case of distress.
- Clients are required to provide an emergency contact before beginning training.
5. LIMITATIONS OF LIABILITY
- Mywowfit’s liability shall not exceed the amount paid for training sessions in the 30 days prior to an incident.
- Mywowfit is not responsible for indirect damages such as loss of income due to injury.
6. COMPLIANCE WITH U.S. AND EU LAWS
- This Agreement complies with applicable laws in the U.S. and the European Union.
- For EU clients, Mywowfit services are provided by MYWOWFIT OÜ, registered in Estonia.
- EU consumer protection laws apply, ensuring fair contract terms.
7. GOVERNING LAW & DISPUTE RESOLUTION
- U.S. clients are governed by Delaware law; EU clients by Estonian law.
- Disputes shall first be attempted to be resolved through informal negotiation, then binding arbitration if necessary.
8. CLIENT AGREEMENT & ACCEPTANCE OF TERMS
- By proceeding with payment for any Mywowfit services, the client acknowledges and agrees to these terms.
- Payment confirmation makes this Agreement legally binding.
- Clients accept all risks, release Mywowfit from liability, and assume full responsibility for their well-being.
