This Waiver of Liability and Medical Disclaimer (“Waiver”) applies to participation in MYWOWFIT’s online 1-to-1 personal training services.
MYWOWFIT services are provided by affiliated companies in Estonia and the United States.

In this Waiver, “MYWOWFIT,” “we,” “us” and “our” refer to the MYWOWFIT entity providing the Services to you.
1. ONLINE PERSONAL TRAINING AND MEDICAL DISCLAIMER
MYWOWFIT is an online personal training service.
MYWOWFIT trainers provide fitness and movement instruction and are not acting as physicians, medical practitioners or healthcare providers.
MYWOWFIT does not provide medical diagnosis, medical treatment or emergency medical care.
The Services are not intended to replace professional medical advice, diagnosis or treatment.
If you have questions or concerns about whether exercise is appropriate for you, you should consult an appropriate healthcare professional before participating.
You should not disregard professional medical advice or delay seeking medical care because of information provided by MYWOWFIT or a trainer.
2. VOLUNTARY PARTICIPATION AND ASSUMPTION OF RISK
You understand that participation in physical exercise involves inherent risks.
These risks may include, among other things, muscle soreness, strains, sprains, falls, aggravation of an existing condition, cardiovascular events or other physical injury.
You voluntarily choose to participate in MYWOWFIT online personal training and acknowledge the risks normally associated with physical exercise.
You agree to follow reasonable trainer instructions and to stop exercising if you experience significant pain, dizziness, unusual shortness of breath, weakness or other symptoms that cause concern.
3. RESPONSIBILITY FOR YOUR TRAINING ENVIRONMENT
MYWOWFIT training is provided remotely.
Your trainer is not physically present in your location and may not be able to fully observe your surroundings, equipment or physical condition.
You are responsible for taking reasonable steps to ensure that:
  • you have sufficient and reasonably safe space to exercise;
  • any equipment you use is in suitable condition;
  • your clothing and footwear are appropriate for the activity;
  • hazards in your immediate training area are removed where reasonably possible; and
  • you stop an exercise if you believe continuing may be unsafe.
You should tell your trainer if you are unable to perform an exercise safely or comfortably.
4. HEALTH-RELATED INFORMATION
You should inform your trainer of injuries, pain, physical limitations or other health-related circumstances that you believe are relevant to adapting your training safely.
MYWOWFIT does not require you to provide detailed medical records, diagnostic reports or unrelated medical information.
Health-related information that you choose to provide may be processed by MYWOWFIT as described in the Privacy Policy.
Acceptance of this Waiver does not constitute blanket consent to the processing of health-related information.
Where applicable law requires explicit consent for such processing, MYWOWFIT will request that consent separately.
5. CLIENT RESPONSIBILITY
You are responsible for making reasonable decisions about your own participation in exercise.
You agree to:
  • provide information that you believe is reasonably relevant to safe participation;
  • inform your trainer if your condition or ability to exercise changes;
  • follow reasonable safety instructions;
  • stop exercising when you believe continuing may be unsafe; and
  • seek appropriate professional medical assistance when necessary.
A trainer may modify, pause or stop an exercise or session where they reasonably believe that continuing would be inappropriate or unsafe.
6. EMERGENCY SITUATIONS
MYWOWFIT does not provide emergency medical services.
Because MYWOWFIT provides online personal training remotely, trainers cannot guarantee that they will be able to contact or coordinate emergency services in your location.
You should have access to a telephone and know how to contact the appropriate emergency services in your location while participating in online training.
If you believe you are experiencing a medical emergency, stop exercising immediately and contact the appropriate local emergency service.
At this time, MYWOWFIT does not require an emergency contact as a condition of participation.
7. RELEASE AND ASSUMPTION OF INHERENT RISKS
To the maximum extent permitted by applicable law, you acknowledge and accept responsibility for injuries or losses arising from the ordinary and inherent risks of voluntarily participating in physical exercise.
To the maximum extent permitted by applicable law, you release MYWOWFIT, its affiliated companies and trainers from claims arising solely from those ordinary and inherent risks of participation.
This release does not apply to liability that cannot lawfully be waived, excluded or limited.
Nothing in this Waiver excludes or limits any mandatory consumer right or any liability that applicable law requires MYWOWFIT to retain.
8. LIMITATION OF LIABILITY
Any limitations on MYWOWFIT’s liability are governed by the MYWOWFIT Terms of Service.
This Waiver does not create a separate or conflicting liability cap.
Nothing in this Waiver excludes or limits liability where doing so would be prohibited by applicable law.
9. ONLINE TRAINING LIMITATIONS
You understand that online personal training has limitations that differ from in-person training.
A trainer may not be able to:
  • physically assist or support you;
  • inspect your training environment in full;
  • verify the condition of your equipment;
  • observe every movement or symptom;
  • assess a medical condition; or
  • provide emergency medical assistance.
You agree to communicate promptly if you experience difficulty, discomfort or a safety concern during a session.
10. NO GUARANTEE OF RESULTS
MYWOWFIT does not guarantee any specific fitness, weight-loss, strength, mobility or other physical result.
Results differ between individuals and may depend on consistency, participation, physical condition, lifestyle and other factors outside MYWOWFIT’s control.
11. MINORS AGED 16 OR 17
MYWOWFIT services are generally intended for adults aged 18 or older.
Where permitted by applicable law, an individual aged 16 or 17 may participate only where a parent or legal guardian manages the relationship with MYWOWFIT in accordance with the Terms of Service.
The parent or legal guardian must accept this Waiver on behalf of the participant and provide any other permissions or consents required by applicable law.
MYWOWFIT does not provide its online personal training services to individuals under the age of 16.
12. RELATIONSHIP WITH OTHER MYWOWFIT TERMS
This Waiver should be read together with the MYWOWFIT:
  • Terms of Service
  • Privacy Policy
  • Code of Conduct
  • Cancellation, Refund, Referral Policy and Session Expiration Policy
If there is a conflict concerning privacy and Personal Data, the Privacy Policy applies to the handling of Personal Data.
If there is a conflict concerning contractual liability, payments, cancellations or dispute resolution, the Terms of Service and applicable mandatory law apply.
13. GOVERNING LAW AND DISPUTES
The governing law and dispute-resolution provisions applicable to your relationship with MYWOWFIT are set out in the Terms of Service.
For United States clients, the applicable contracting entity is Online Fitness Technologies Inc.
For clients outside the United States, the applicable contracting entity is MYWOWFIT OÜ.
Nothing in this Waiver deprives consumers of mandatory rights or protections available under applicable law.
